Who we are

SWAY PRO is made by Beeldify, a small studio from the Netherlands. In these terms, “we” means Beeldify and “you” means the person using SWAY PRO. By downloading or using SWAY PRO, you agree to these terms.

Free trial

Every new user can use SWAY PRO free for 30 days from the first time it opens on their Mac. You don’t need to enter payment details. After 30 days SWAY PRO locks until you buy a subscription. Nothing is charged automatically when the trial ends.

Subscription and billing

• SWAY PRO costs €8.99 per year. VAT or sales tax for your country is added at checkout.
• Payments are handled by Lemon Squeezy, which sells SWAY PRO on our behalf as the merchant of record. Your payment, invoice and tax are handled by Lemon Squeezy, and their buyer terms also apply to your purchase.
• Your subscription renews automatically every year, charged to the payment method you used, until you cancel.
• If we ever change the price, we’ll tell you by email before it applies to your next renewal, so you can cancel first if you don’t agree.

Cancelling

You can cancel any time, with no notice period. In SWAY PRO, open Settings → License → Manage subscription, or use the link in your purchase email. After cancelling, SWAY PRO keeps working until the end of the year you already paid for, and then it locks. You won’t be charged again. You can resume your subscription before it ends if you change your mind.

Refunds and outages

We don’t refund the remaining part of a period when you cancel, and we don’t give refunds or credit when SWAY PRO is temporarily unavailable or doesn’t fully work for a while. That includes:

• a bug or error on our side that we’re working to fix;
• changes, limits or outages at Spotify, macOS or another service SWAY PRO relies on;
• maintenance and updates.

We’ll always work to fix problems as quickly as we can, and you can cancel your subscription at any time.

This doesn’t limit your rights under the law. If you’re a consumer in the EU, you keep your legal rights when a digital product doesn’t work as described, and your rights regarding withdrawal from a purchase, which Lemon Squeezy handles as the seller. If you think something is wrong with your purchase, contact us and we’ll look at it fairly.

Your license

• Your subscription gives you a personal license to use SWAY PRO for as long as it’s active.
• One license key works on one Mac at a time. You can move it to another Mac with Settings → License → Remove from this Mac.
• SWAY PRO checks your license with Lemon Squeezy once a day. If your Mac is offline, it keeps working for 14 days from the last successful check.
• You may not share or resell your license key, or copy, modify, reverse engineer or redistribute SWAY PRO. Beeldify keeps all rights to SWAY PRO.

Spotify

SWAY PRO works with your own Spotify account and the Spotify app on your Mac. Browsing Spotify inside SWAY needs Spotify Premium and your own free Spotify Developer app. SWAY PRO doesn’t contain, sell or distribute any music.

SWAY PRO isn’t made, endorsed or sponsored by Spotify. Spotify is a trademark of Spotify AB. Your use of Spotify is covered by Spotify’s own terms. Spotify can change or limit how apps like SWAY PRO connect to it, which may affect some features; see Refunds and outages.

Availability and liability

We work hard to keep SWAY PRO reliable, but we provide it “as is” and can’t promise it will always be available or free of errors. Features may change or be improved through updates.

As far as the law allows, our total liability to you is limited to the amount you paid for SWAY PRO in the 12 months before the problem happened. We aren’t liable for indirect losses. Nothing in these terms limits liability that can’t be limited by law.

Changes and law

We may update these terms. If a change matters to you, we’ll let you know by email or in the app before it applies. These terms are governed by Dutch law. If you’re a consumer, you also keep the protection of the consumer laws of the country you live in.

Privacy

SWAY PRO has no analytics, no ads and no tracking. You don’t need an account with us. Here’s exactly what leaves your Mac, and where it goes:

• License check: your license key and your Mac’s name go to Lemon Squeezy, to activate and check your license. Lemon Squeezy also has your email and payment details from your purchase. See the Lemon Squeezy privacy policy.
• Spotify: SWAY PRO talks directly to Spotify from your Mac. Your Spotify login is stored in your Mac’s Keychain, and your library is cached on your Mac. None of it is sent to us.
• Visualizer: if you turn it on, SWAY PRO analyses the sound playing on your Mac to draw the visualizer. Audio is processed on your Mac only and is never recorded, saved or uploaded.
• Updates: SWAY PRO checks beeldify.com for updates. Like any website visit, this shares your IP address with our web host.
• Emails: if you contact us, we use your message and email address only to help you.

We don’t sell your data. You can ask us what we hold about you, or ask us to delete it, by emailing us.
